1. Acceptance and Operator
By downloading, installing, creating an account, purchasing a subscription, or using Talder (the “App”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App.
Talder is operated under the name Talder Team by an independent service operator based in Italy (“we”, “us”, “our”). These Terms form an agreement between you and Talder Team. Questions may be sent to talderapp@gmail.com.
2. Eligibility
You must be at least 13 years old and meet the minimum digital-consent age required in your country to use Talder. If local law requires authorization from a parent or legal guardian, you may use the App only with that authorization. Talder is not directed to children under 13 and does not provide a parental-consent verification service.
By using the App, you represent that you satisfy the age and legal-capacity requirements that apply to you.
3. Account Registration and Security
You may register with email and password, Sign in with Apple, Google Sign-In, or TikTok Login. You must provide accurate information, protect your credentials and devices, and promptly notify us if you suspect unauthorized access.
You may not create accounts to impersonate another person, evade a suspension, scrape the service, spam, harass, or exploit other users. Usernames, custom IDs, profile images, badges, and styling must not mislead, infringe rights, or violate these Terms. We may rename, restrict, or remove violating profile elements.
4. Service Features
Talder provides direct and group messaging, images, view-once media, voice messages, location messages, calls, real-time Push-to-Talk, groups, friend discovery, optional contact matching, optional live location and battery sharing, optional Spotify or Apple Music activity sharing, profile customization, push notifications, Live Activities, and premium features.
Supported one-to-one talks and calls may apply a voice effect selected on the sending device before audio is transmitted. Effects can change intelligibility and are provided for communication and entertainment; they must not be used for fraud, impersonation, deception, harassment, or unlawful purposes.
Talder includes end-to-end encryption infrastructure, but its general rollout is currently disabled. Until E2EE is enabled for a supported flow, content is protected in transit using TLS but is not end-to-end encrypted. When enabled, E2EE is used only for the content types, clients, recipients, groups, and rollout states that support it. Legacy, compatibility, notification, metadata, and other disclosed operational flows are not end-to-end encrypted. The Privacy Policy explains these limits.
5. User-Generated Content and Safety
You are responsible for messages, audio, images, profile information, location, and other content you create or share. You must have the rights and permissions needed to share it, including consent before sharing another person’s private information, image, voice, or location.
You may not publish or transmit illegal, exploitative, sexually abusive, threatening, hateful, defamatory, privacy-invasive, malicious, or rights-infringing content; promote self-harm or violence; groom or exploit minors; distribute spam or malware; or use Talder for stalking, fraud, non-consensual recording, or doxxing.
You can block abusive users in the App. Report offensive content or conduct through Profile → “Suggest or report” or by emailing talderapp@gmail.com with enough information to investigate. We may review reports, restrict features, preserve relevant evidence when legally permitted, remove content, or suspend or terminate accounts. Emergency or immediate-danger situations should be reported to local emergency services, not Talder support.
6. Your Content and Intellectual Property
You retain ownership of your content. You grant us a limited, non-exclusive, worldwide license to host, cache, reproduce, transmit, encrypt, decrypt where technically required for a disclosed non-E2EE flow, and display that content only as necessary to operate, secure, troubleshoot, moderate, and provide Talder. This license ends when the content is deleted from our active systems, except for lawful retention, backups, security evidence, and copies already delivered to other users.
View-once media limits ordinary repeated access inside Talder but cannot prevent screenshots, screen recording, camera capture, recipient-device backups, or external recording.
Talder software, design, logos, and branding are protected by intellectual-property laws. These Terms do not grant permission to copy, reverse engineer where prohibited, redistribute, or misuse them.
8. Third-Party Services
Talder relies on services operated by Apple, Google, TikTok/ByteDance, Spotify, Render, Turso, Cloudflare, and Google’s Gmail infrastructure, as described in the Privacy Policy. Your use of third-party login, music, purchase, platform, and notification services may also be governed by their terms and privacy policies.
We do not control third-party availability or decisions. Disconnecting or revoking a third-party account may disable the corresponding Talder feature.
9. Privacy
The Privacy Policy is part of these Terms and explains what personal data is processed, why, for how long, with whom it is shared, and how to exercise your rights. Optional permissions and sharing features can be disabled as described there.
10. Service Availability and Changes
Talder may experience maintenance, network interruption, provider outages, beta defects, delayed notifications, or feature changes. We may update, limit, replace, or discontinue features when reasonably necessary, including for security, legal, technical, provider, or App Store requirements.
Talder is not an emergency, dispatch, safety-monitoring, medical, or guaranteed location-tracking service. Push notifications, location refreshes, battery status, online presence, and Live Activities may be delayed, unavailable, or inaccurate and must not be relied on to protect life, health, or property.
11. Suspension and Account Deletion
You may delete your account through the App’s account settings. Deletion removes or deactivates associated data from active systems as described in the Privacy Policy, but cannot erase content already delivered to another person’s device and does not cancel an Apple subscription.
We may restrict, suspend, or terminate an account that violates these Terms, creates safety or security risk, infringes rights, abuses the service, or must be restricted by law or a platform provider. Where appropriate and legally required, we will provide notice or an opportunity to contact support.
12. Disclaimer of Warranties
Talder is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and error-free or completely secure service.
Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded in your country.
13. Limitation of Liability
To the extent permitted by law, Talder Team is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss caused by unavailable communications, inaccurate status or location, third-party services, unauthorized capture by recipients, or events outside our reasonable control.
Where liability may legally be limited, our aggregate liability arising from Talder will not exceed the amount you paid for Talder during the 12 months before the event giving rise to the claim. This limitation does not apply to fraud, willful misconduct, gross negligence, personal injury, or mandatory consumer liability that cannot be excluded.
14. Changes to These Terms
We may update these Terms to reflect service, legal, safety, or provider changes. We will show the new date and, where required, provide prominent notice or request renewed acceptance. Changes do not retroactively reduce rights already accrued. If you do not accept a material update, stop using Talder and delete your account before the update becomes effective.
15. Governing Law and Consumer Rights
These Terms are governed by Italian law, without prejudice to mandatory consumer protections, choice-of-law rules, and court jurisdiction available in your country of habitual residence. Nothing in these Terms prevents an eligible consumer from using a competent consumer-protection authority or legally available alternative dispute-resolution procedure.
